If you do not agree with any part of these Terms, you are prohibited from using or accessing the Service. FlowChai and its licensors retain all proprietary rights to the Service and its content, including but not limited to text, graphics, logos, images, as well as the compilation thereof, and any software used on the Service. The Service is protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, labels, or restrictions contained within or attached to the Service and not to copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information without the express written consent of FlowChai or the rightful owner.
FlowChai grants you a limited, non-exclusive, non-transferable license to access and use the Service strictly in accordance with these Terms. You may not attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to any FlowChai server through hacking, password mining, or any other means.
FlowChai reserves the right, in its sole discretion, to terminate your access to all or part of the Service, with or without notice, for any reason or no reason, including without limitation, breach of these Terms. You may cancel your account at any time through the Service interface or by contacting FlowChai support directly. Upon termination or cancellation, your right to use the Service will immediately cease, and FlowChai may, without liability to you or any third party, immediately deactivate or delete your user name, password, and account, and all associated materials, without any obligation to provide further access to such materials.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. FlowChai expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FlowChai makes no warranty that the Service will meet your requirements, that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from the use of the Service will be accurate or reliable, or that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
To the fullest extent permitted by applicable law, in no event will FlowChai, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not FlowChai has been informed of the possibility of such damage.
You agree to defend, indemnify, and hold harmless FlowChai, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Service.
